TERMS AND CONDITIONS OF HIRE The Shires Van Hire Parties The Shires Van Hire, Unit 2, Lawrence Way, Dunstable, Bedfordshire, LU6 1BD. (“the Company”) (“the Renter”) 1. Introduction 1.1 These conditions shall apply to all contracts for the rental of vehicles by the Company to the Renter to the exclusion of all other terms and conditions. Any variation to these conditions (including any special terms and conditions agreed between the parties) shall be invalid unless agreed in writing by the Company. 1.2 Where the person signing the Agreement on behalf of the Renter is not the Renter he or she represents the warrants to the Company that she or he is authorized to sign into this Agreement for and on behalf of the Renter and that all warranties and obligations on behalf of the Renter herein shall be deemed to be made or entered into by such person jointly and severally with the Renter. 2. Hire of Vehicle 2.1 The Company agrees to hire the vehicle to the Renter and the Renter agrees to take on hire the vehicle according to the terms and conditions of this Agreement for the period specified on the front of this Agreement/ booking form. If the renter fails to keep to these terms the company will be under no obligation to refund the booking fee or deposit. 2.2 At the time of the hire the Renter acknowledges and agrees that the vehicle is fit for the purpose and undertakes to return the vehicle the date and location specified on the front of this Agreement. 2.3 The period of hire will commence on the time and date specified overleaf and shall continue under the terms of this Agreement (subject to early termination by either party or any extension of time in accordance with the terms of this Agreement). 2.4 The period of hire may not be extended without the Company’s consent. Should the Renter fail to return the vehicle on the date and time specified then the rental will be charged an additional day’s hire for every day or part therefore until the vehicle is returned at the rate of per day. 2.5 In any event this Agreement will only last a maximum of 30 days. 2.6 The Renter will be unable to hire any one vehicle for more than 90 days per calendar year. 3. Permitted Uses 3.1 The Renter will only use the vehicle for the use indicated to the Company at the time of hire specified at the front of this Agreement. The Renter is responsible for ensuring any passengers are carried or goods are carried in accordance with the insurance in place for the duration of the hire and the Company will not be responsible for any loss occasioned by the negligence, willful neglect or misfeasance on the part of the Renter. 3.2 The Renter will not allow the vehicle to be driven by any person who has not been authorised in writing by the Company. 3.3 The Renter will not take the vehicle outside the United Kingdom without the Company’s consent, but in the event the Renter does wish to take the vehicle outside the United Kingdom he should contact the Company immediately and make the necessary arrangements. 3.4 The Renter or any driver is responsible for: 3.4.1 ensuring that the vehicle will not be used for hire or reward; 3.4.2 ensuring that the vehicle will not be driven by: 3.4.2.2 any person not licensed to drive the vehicle; 3.4.2.3 any per son under the age of 21 and over the age of 70; 3.4.2.4 any person who has been convicted of a motoring offence the details of which have not been disclosed in writing at the time of hire or during the hire to the Company. 4. Payments 4.1 The Renter will pay to the Company the following sums: 4.1.1 The deposit specified overleaf prior to commencement of the hire; 4.1.2 The insurance premium as maybe agreed from time to time between the Renter and the Owner; 4.1.3 The Ł500 excess under the terms of the insurance policy in the event of a claim; 4.1.4 The Renter will pay immediately upon demand the cost of any accidental/intentional damage to the vehicle during the equipment stored or transported in or upon the vehicle). 4.1.5 All fines, charges, penalties, costs, expenses (including all charges and penalty charges incurred under a charging scheme) incurred in relation to the vehicle by the Renter or driver from the commencement of the hire until the vehicle is returned to the company. 4.1.6 Any taxes payable in respect of the above including VAT. 5. Breakdown/Repairs 5.1 In the event the vehicle breaks down during the period of hire, the Renter must notify the Company immediately. The Company will arrange to remove the vehicle and provide the Renter with a replacement. If a replacement is not available then the Company will refund the remaining period of hire outstanding. 5.2 The Company will not be under any obligation to pay any compensation whatsoever in respect of any loss arising out of the breakdown of any vehicle. 5.3 In the event that repairs are required to the vehicle, no repairs may be carried out without the Company’s consent. This may invalidate any policy of insurance in force from time to time. 6. Renter’s Obligations 6.1 The Renter shall at all times during the term of this Agreement ensure that the vehicle is kept in good and substantial repair and take proper care of the vehicle at all times, immediately report any accident, loss or damage involving the vehicle to the Company, call police or any other relevant authority and at the owners request co-operate fully in respect of any claim to any insurance company. 6.2 Immediately report any breakdown or fault with the vehicle, the vehicle shall be replaced/repaired in line with clause 5 above. 6.3 Not to repair the vehicle without the Company’s consent as set out above. 6.4 Not to modify, alter or adapt the vehicle in anyway during the period of hire without the Company’s consent. 6.5 Not to sell, mortgage, charge or otherwise pledge or assign the vehicle in whole or in part (including for the avoidance of doubt the accessories on the vehicle) or otherwise deal with the vehicle in a manner which may be construed as inconsistent with the Company’s ownership/rights .7. Company’s Obligations/Limitation of Liability 7.1 During the period of hire the Company undertakes as follows: 7.1.1 To ensure that the vehicle provided to the Renter is in good and substantial repair. 7.1.2 To deal promptly with any breakdown and/or repairs during the period of hire. 7.1.3 In the event that repairs cannot be carried out then to provide if possible a replacement vehicle. 7.1.4 All other warranties, conditions or terms related to contracts of hire, whether expressed or implied by statute or common law or otherwise excluded to the fullest extent permitted by law. In particular, (but without limitation as set out above) the Company shall not be responsible/liable to the Renter for any indirect, direct or consequential loss of damage arising out of terms of this Agreement during the hire period. 7.1.5 Nothing contained in this Agreement shall restrict or exclude the Company’s liability for death or personal injury caused by the Company’s negligence. 8. Insurance 8.1 During the hire period, as set out overleaf, the Renter shall ensure that the vehicle is adequately insured at all times. 8.2 In the event that adequate insurance in not in place then the Company reserves the right to terminate this Agreement with immediate effect. 8.3 The Renter shall have the option of taking out insurance offered by the Company on such terms as may be stated from time to time. 8.4 As set out above the Renter shall be responsible for any excess on any policy of insurance however so caused. 8.5 In the event of an insurable act arising under the terms of any insurance policy, (including in the event of a road traffic accident), the Renter agrees as follows: 8.5.1 To endeavour to obtain names and addresses of any parties involved in the incident including any witnesses; 8.5.2 Not to admit any liability or fault to any third party; 8.5.3 Not to abandon the vehicle without notifying the Company and ensuring the vehicle is safe and secure; 8.5.4 Immediately notify the Company of any incident, providing such details as the Company may request including particulars of the date and time of the incident, all parties involved and any injuries. 8.6 Where the Renter has opted to personally insure a vehicle the Renter agrees to provide on demand (at any time) a copy of the policy of insurance, together with any Schedule referred to. 9. Identification 9.1 Prior to any period of hire, the Renter agrees to provide and will provide on demand ( at any time) a copy of any identification including passport, driving licence and utilities bill. 10. Indemnity 10.1 The Renter will indemnify and hold harmless the Company and keep the Company indemnified in respect of all costs, claims, losses, damages and expenses and liability whatsoever incurred, suffered or sustained as a result of: a) A breach by the Renter of any terms of this Agreement or any ancillary Agreement entered into. b) Any loss or damage to property stored or transported by the Renter or any other person authorized to drive the vehicle, or any passenger within the vehicle. 10.2 In the event of a third party claim the Renter will co-operate with all reasonable requests of the Company and will participate to the full extent necessary in any Court proceedings. In the event that costs are not recoverable the Renter will be responsible for his own costs and expenses. 11. Termination 11.1 In the event the valid insurance is not in place this Agreement will terminate immediately as set out above. 11.2 In addition, the Agreement will terminate on the following events: 11.2.1 Any material representation or breach of this Agreement or warranty by the Renter in respect of himself, additional driver or passengers; 11.2.2 If the Renter goes into liquidation, receivership or administration; 11.2.3 Should the Renter become bankrupt or a bankruptcy petition filed; 11.2.4 For non-payment of any of the charges referred to in the terms of thisAgreement; 11.3 On the expiry or termination of this Agreement, howsoever the Renter will return the vehicle to the Company. The Company will be at liberty to carry out any inspection it sees fit in respect of the vehicle. Further the Company reserves the right to take possession of the vehicle during the currency of this Agreement by giving the Renter such notice as may be reasonable in the circumstances. 11.4 In the event the Company takes possession of the vehicle for a reason other than breach of this Agreement then the Company will endeavor to replace the vehicle and/or refund the remaining period of hire. 12. Entire Agreement 12.1 This Agreement constitutes the entire Agreement between the parties and no variation to this Agreement shall be binding unless agreed in writing by the Company.
